It is important to run though the following key product features, covers, special restrictions and some important areas that would not be covered by the policy as a minimum set of declarations prior to the sale of the policy.
There are a number of Platinum options with various indemnity limits which is summarised in the following table:-
Guide to the different levels of the Family Platinum policy
Please ensure that the policyholder is made aware of the following policy conditions and exclusions prior to purchase.
- Personal Injury: This section excludes injury claims relating to a road traffic accident and clinical negligence claims.
- Employment Disputes (£25k or £50k cover limits): Any claim not reported within 30 days of dismissal. A policy excess of £250 is payable by the policyholder for all employment dispute claims.
- Criminal Prosecution Defence:
- (a) any offence which is not a strict liability offence.
- (b) any strict liability offence involving a motor vehicle, offences of a sexual nature or offences related to the policyholder’s business or profession.
- Contract Disputes: Excludes the following;
- (a) contracts related to profession, business or employment.
- (b) contracts involving a motor vehicle.
- (c) disputes relating to advice or settlement of an insurance policy or financial product.
- (d) any contract related to building or construction work including extension or conversion work at the policyholder’s main residence.
- Tax Protection: HMRC enquiries into earnings related to self-employment are not covered as are any claims where the policyholder has made deliberate misstatements and/or omissions to the HMRC.
- Jury Service: Does not cover any loss of earnings related to self-employment.
- Property Protection: Excludes the following;
- (a) any building or land other than the policyholder’s main residence.
- (b) any work carried out by any local or public authority unless the claim is for accidental damage.
- (c) any claim relating to a motor vehicle.
- (d) claims related to mining subsidence. A policy excess of £250 is payable by the policyholder for any nuisance or trespass related claims under this section.
- Education Admission Appeals: Excludes the following where the policyholder:
- (a) includes a school within their application which is outside the LEA catchment area.
- (b) did not follow the LEA appeals process.
- (c) has applied for a child that has been expelled or permanently excluded from another school.
- Wills & Probate: Excludes cover where;
- (a) the deceased did not make a will
- (b) where the will subject to dispute does not fulfil the legal. requirements for making a will (e.g. was not signed by 2 witnesses in presence of the person making the will).
- House Sale/Purchase: Excludes cover where;
- (a) the amount in dispute is less than £500.
- (b) the property is not the policyholder’s main residence.
- (c) the policyholder has withdrawn from the transaction.
- Travel Disputes: Excludes;
- (a) any travel outside Europe.
- (b) any event that is not reported within 30 days of returning from holiday subject to dispute.
- (c) any claim where the goods or services in dispute is less than £150.
- Identity Theft: Excludes cover where;
- (a) identity theft relates to a business, profession or occupation.
- (b) the matter is attributable to the policyholder’s failure to safeguard their personal information including PINs and passwords.
- Social Media Defamation: Where the person subject to the defamation is less than 18 years of age.
Key Policy Conditions & General Exclusions:
- The free 24/7 Legal Advice Helpline is for general advice only and policyholders should be informed that they must not rely on the free legal advice instead of reporting a claim.
- The policy covers the policyholder and any member of their family (including civil partners and children for whom the policyholder and spouse/civil partner are the legal guardian) that permanently resides with them at their main home of residence.
- All claims must be reported as soon as possible and in any event within 180 days of the event giving rise to the claim.
- For all legal claims there must be a reasonable prospect of success, i.e. a greater than 51% chance, that a claim will succeed and the claimant will be able and likely to obtain the compensation or none financial result that they are seeking.
- Any legal or associated costs that the policyholder has incurred prior to reporting the claim are not covered.
- All claims for any matter that was not caused by a specific or sudden incident/event are excluded.
- Any claims that arise from a criminal act or omission are excluded.
- Any claim for incidents that occurred outside the United Kingdom (including N.I.) the Channel Islands or the Isle of Man are not covered as are any claims that occurred outside the period of cover detailed on the policyholder’s policy schedule.
FAQs
The service will provide generic legal advice over the telephone and no formal correspondence will be entered into. Policyholders must not use the helpline as an alternative to making a claim on the policy.
There are no set limits for use of the helpline, however, this service can be withdrawn if a policyholder’s use of the helpline is deemed to have been excessive and therefore unreasonable.
Yes – there are various policy limits ranging from £75,000 to a maximum of £100,000, for the Platinum range of products. There are also some specific set limits for individual sections of the policy.
